Contract for Mailbox Service

This Agreement by and between ATMB Customer and Box & Ship shall be governed by these terms to which each party agrees:
1. Contract: By completing this form and PS Form 1583, which will be made available to the United States Postal Service® (USPS), Customer appoints Mail Service as agent for the receipt of mail and packages through common carriers for a period not to exceed that for which rent has been paid in advance. Customer will pick up mail and other shipments at least once each week or make other suitable arrangements, in advance, with Mail Service.
2. Lawful Use: Customer agrees that they will not utilize PMB or Mail Service for any unlawful, illegitimate, or fraudulent purpose, or for any purpose prohibited by the USPS. Customer further agrees that any use of PMB <|Mailbox#|> shall be in conformity with this Agreement and all applicable federal, state, and local laws. Each individual or entity must complete a separate United States Postal Service® Form 1583 (“Form 1583”) to be authorized to receive mail or packages at Box & Ship
3. Delivery by USPS: Customer agrees to release and absolve the United States Postal Service® (USPS) and its direct representatives from any and all liability or responsibility for mail that has been delivered to Box & Ship by USPS personnel. All collection, distribution, handling, forwarding or other related services are hereto considered to be separate, non-related transactions of business between Customer and Mail Service.
4. Delivery by Mail Service: Mail Service is not engaged in the delivery of mail or other carrier shipments and cannot be responsible for failure in the USPS or other carriers to deliver in a timely fashion or undamaged condition.
5. Authorized Individual: Customer authorizes themself as Authorized Collector of mail per USPS definition. Should Customer appoint another person to collect mail or other shipments, it is the responsibility of Customer to provide that individual’s name and identifying documents to the Mail Service for collection by the USPS. Mail Service representatives shall assume that access to the ATMB App and pickup schedule are evidence of authority to collect mail or other shipments and that the customer has supplied the USPS required information for the designated Authorized Individual.
6. Identification: Per USPS regulation, Customer’s Photo and Address identification must be current and not expired. Customer is required to provide updated Photo Identification if the ID has expired during the mailbox term. Customer is further required to notify Mail Service of any change in permanent address and provide updated Address identification.
7. Forwarding: USPS regulation requires Customer to complete a new PS 1583 each time the official forwarding address for mail is changed. Customer is responsible for adding Forwarding addresses and completing required paperwork.
8. Compliance: Customer agrees to use services in accordance with Mail Service rules and in compliance with USPS regulations, as well as local, state, and federal statutes and regulations. Requests for updated identification or other required information will be provided in the App or via email communication. Failure to promptly supply requested information may result in cancellation of service without notices, refund, or mail forwarding.

9. Confidentiality: Information provided by Customer will be kept confidential and will not knowingly be disclosed without Customer’s prior consent, except for law enforcement or postal operation purposes, in which case Mail Service intends to cooperate fully. Law enforcement is further clarified to include all city, county, state or federal agencies or their representatives acting in their official capacity.
10. Authorized Recipients (Residential): All mail recipients must complete a separate PS 1583 and provide required documentation BEFORE Mail Service can accept mail on their behalf. Minor children must be listed on PS Form 1583. Additional documentation may be required by Mail Service for minors, disabled recipients, or individuals under a POA or similar legal agreement. Mail for non-registered individuals will be marked as “Undeliverable” per USPS regulation and returned to sender.
11. Authorized Recipients (Commercial): All employees receiving mail for a registered company must be listed on PS Form 1583 BEFORE Mail Service can accept mail on their behalf. The company name is required to be included on all mail pieces for any employees without an executed PS Form 1583. Mail for non-registered companies and/ or employees will be marked as “Undeliverable” per USPS regulation and returned to sender.
12. Restrictions: Customer agrees that parcels delivered to this address for the Customer will be delivered by common carrier only, that no truck line deliveries will be made, and that no hazardous or dangerous material will be delivered to Customer. Personal deliveries or deliveries without an established chain of custody will not be accepted. Failure to adhere to any of these parcel delivery stipulations will result in additional fees and/or termination of service.
13. Indemnity: Customer agrees to protect, indemnify, and hold harmless Box & Ship from and against any and all claims, demands and causes of action of any nature whatsoever relative to use of Mail Service facilities or services.
14. Liability: Should Mail Service commit or fail to commit an act that results in disruption of service and Customer thereby suffers a loss, Mail Service’s liability shall be limited to any Mail Service fees paid by Customer for service not yet received or $100 whichever is less. Mail Service shall not be liable for incidental or consequential damages.
15. Accountable Mail: Per USPS regulations, Mail Service will accept all types of properly addressed mail for registered recipients including but not limited to certified, insured, registered or restricted mail. C.O.D. charges must be made to Mail Service prior to acceptance of C.O.D. packages. Properly addressed Accountable mail may not be refused and returned to sender by Customer per USPS regulations.
16. Fees: Mail Service fees are due and payable on the ATMB app. Failure to pay such fees when due may result in disruption or cancellation of services. Mail Service does not prorate fees and does not provide refunds in the event of cancellation by Customer or Termination with Cause by Mail Service. Box & Ship reserves the right to assess fees for additional services, failure to adhere to requirements or failure to respond to attempts to gather USPS required information.
17. Addressing: The address to be used by Customer for the purpose of receiving mail must conform to USPS DMM regulation. Customer shall use only the address designation “PMB” or “#” to designate their address. NO OTHER DESIGNATION IS VALID. Specifically excluded is the use of suite, apt, dept, or other physical designators. The USPS may refuse to deliver any piece of mail that does not include the “PMB” or ” #” designation. Customer is responsible for notifying correspondents of the correct address format.

18. End of Term: Upon conclusion of Mail Service Term or cancellation of Mail Service by Customer, Customer agrees not to submit a Change of Address Order with the USPS. It is the sole responsibility of Customer to notify correspondents of a change in receiving address prior to cancellation of Mail Service. Box & Ship does not offer mail forwarding to Customers without an active and paid Mail Services Agreement in place. This constitutes a “Do Not Forward” agreement as per DMM 508.1.8.3.b.
19. Failure to Pay: Failure to pay rent in advance by Customer will result in termination of mail services at which time Customer understands that per USPS regulation, Mail Service must continue to accept mail for Customer for a period of 180 days after termination. Mail Service will not make this mail available to Customer without payment in full for services rendered. Mail Service will handle such mail in accordance with USPS DMM regulations.
20. Termination With Cause: Repeated failures to adhere to USPS or Mail Service requirements will result in termination of services. Suspicious activity will be reported to USPIS in accordance with postal regulation and mail will be handled in accordance with instructions provided by USPIS during their investigation.
21. Duration: The term of this Agreement shall be the initial period paid for by Customer and any renewal period paid for by Customer from time to time. Renewal of this Agreement for additional terms shall be at Center’s sole discretion. The terms of this Agreement extend to any individual or entity registered to PMB.
22. APPLICANT AGREES NOT TO USE MAIL RECEIVING ADDRESS TO REPRESENT A PHYSICAL LOCATION FOR A BUSINESS ON GOOGLE, BING, YELP OR ANY OTHER ONLINE BUSINESS LOCATION MAPPING SERVICE.
23. Applicants that do not schedule Mail pickup on the app will be charged a $3 service fee for Box & Ship staff to create the pickup event. This fee is in addition to the storage and pickup fees associated with the mailbox service level.
